Privacy Notice and Authorization for the Processing of Personal Data

The fields in double brackets (for example [[NOMBRE_DEL_CLIENTE]]) are filled in by each customer with their own details before publishing it to their patients. NexToCloud acts solely as Data Processor.

Data controller#

What do we use your data for?#

We will process your personal data, including health data when necessary, to:

  1. Schedule, confirm, remind you of, reschedule and cancel your appointments and procedures.
  2. Manage authorizations with your insurer or payer.
  3. Provide you with healthcare and comply with medical record (historia clínica) obligations and other healthcare sector regulations.
  4. Communicate with you by WhatsApp, phone calls, SMS or email about your care.
  5. Handle your petitions, complaints, claims and suggestions.
  6. Measure the quality of our services through surveys.

Automated assistants and recording#

Some communications may be handled by an artificial intelligence virtual assistant, which only handles administrative matters (appointments, logistical information) and does not provide medical advice. You may ask to be assisted by a person at any time. Calls may be recorded and transcribed to handle your request and as a record of the care provided.

This channel is not for emergencies. In an emergency, go to the nearest emergency department or call the 123 line.

Sensitive Data#

Health data is sensitive data. You are not required to authorize its processing or to answer questions about sensitive data or about minors; however, some of this data is necessary to provide the care you have requested. Data of minors will be processed with the authorization of their legal representative and in their best interests.

Technology providers and international transfer#

For these purposes, we use the NexToCloud technology platform, operated by NTC CAPITAL HOLDING S.A.S., and cloud, messaging, voice and artificial intelligence providers, some of which are located outside Colombia (mainly in the United States). They process your data only on our behalf, under contracts with security and confidentiality obligations.

Your rights#

You may access, update, correct and delete your data, revoke your authorization, request proof of it, be informed of how your data is used, access it free of charge and file complaints with the Superintendence of Industry and Commerce (SIC), by writing to [[EMAIL_PROTECCION_DATOS]]. Deletion or revocation does not apply when there is a legal duty to retain the information, such as the duty to retain medical records.
